Motorcycles are particularly susceptible to dangers from roadway defects or poorly maintained roadways in the City and State of New York caused by poor roadway maintenance or construction. In addition, motorcycle riders are exposed to motorists that endanger the lives of vulnerable motorcyclists in New York every day. Instances in which drivers of four-wheel vehicles strike motorcycle riders without even knowing there was a vehicle close to them have become increasingly common, increasing the rate of motorcycle accidents. Since motorcyclists have minimal protection, the consequences of a motorcycle crash are often quite serious.

The rules governing motorcycles are vastly different for motorcycles than  for motor vehicles in New York State. Specifically, a motorcycle is not a "motor vehicle" within the meaning of the insurance No-Fault rule. Therefore, a motorcyclist is not a "covered person" under No-Fault and is not entitled to medical benefits and lost wages. Given this exemption, motorcyclists must use their private health insurance for medical treatment. This can leave you and your family in a bind, especially if income has been lost due to the accident.

Since Motorcyclists do not qualify under No-Fault, the No-Fault "serious injury" threshold rule does not apply to cyclists. Thus, a person injured in a motorcycle accident can bring a claim against the offending driver even for minor injuries that would normally not qualify as a "serious injury."
